Welcome to Real Submission Grappling, operating under Rickros Submission Grappling LLC ("RSG," "we," "us," or "our"), a Limited Liability Company formed in Florida, United States. These Terms and Conditions ("Terms") govern your use of our website located at realsubmissiongrappling.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you don't agree to these Terms, please don't use our Site.

 

1. Acceptance of Terms

By accessing or using the Site, you affirm that you are at least the age of majority in your state or province of residence (18 years old in Florida) and have the legal capacity to enter into these Terms. If you are accessing or using the Site on behalf of a minor, or making purchases for a minor, you represent that you are the minor's parent or legal guardian and have the authority to bind the minor to these Terms and our separate Participant Waiver and Release of Liability (as further detailed in Section 7). You agree to comply with all applicable laws and regulations regarding your use of the Site.

 

2. Privacy Policy

We care about your privacy. Please refer to our Privacy Policy for information about how we collect, use, and protect your personal data, and your rights regarding such data.

 

3. Third-Party Services 

Our Site is built on the Wix platform and utilizes various third-party services (e.g., payment gateways, analytics tools, communication features). You acknowledge that by using our Site, you also agree to the Wix Terms of Use and other relevant policies of Wix, as Wix acts as our data processor. Your use of the Site is also subject to the terms and conditions and privacy policies of these other third-party providers. We are not responsible for their independent practices.

 

4. Services Offered

We offer various Brazilian Jiu-Jitsu trainings services through the Site, including but not limited to: class bookings, free trial sessions, single private classes, single group classes, group private trainings, training packages, monthly membership plans with recurring charges,​ member-exclusive content, information about our school, instructors, and programs. Some features are available only to registered users.

 

5. Account Registration & Membership 

To access certain features of the Site, such as purchasing services, managing memberships, or utilizing our community features, you might need to register for an account. By creating an account, you agree to:

• provide accurate, current, and complete information during registration

• maintain the confidentiality and security of your password and account credentials

• promptly update your account information if it changes

• accept all risks of unauthorized access to your account

• notify us immediately of any unauthorized use of your account or any other breach of security.

Community Features: if the Wix platform offers community features (e.g., forums, member profiles), you agree to use these features responsibly and respectfully. We reserve the right to monitor, moderate, or remove any content or user that violates our community guidelines (which may be provided separately or incorporated herein).

 

6. Payments, Pricing, and Recurring Charges

6.1. Pricing

All prices for classes, packages, plans, and memberships are listed on the Site in U.S. Dollars (USD) and are subject to change without notice. We reserve the right to modify or discontinue any service or pricing without prior notice.

6.2. Payment Processing

We use Wix Payments or other third-party payment service providers to handle all financial transactions securely. These providers (which may integrate options such as PayPal, Apple Pay, Google Pay, etc.) process your payments on our behalf. By purchasing through our Site, you agree to be bound by the terms and conditions of our chosen payment processor(s). We don't store your full payment card details on our servers.

6.3. Recurring Charges (Monthly Plans)

If you purchase a monthly plan or membership with recurring charges, you agree to the following:

• Authorization: you authorize Rickros Submission Grappling LLC to charge your designated payment method on a recurring basis (e.g., monthly) for the agreed-upon membership fee.

• Billing cycle: your membership will automatically renew at the end of each billing cycle unless you cancel it in accordance with our cancellation policy.

• Price changes: we reserve the right to change monthly plan fees. We will provide you with reasonable advance notice of any price changes.

• Non-payment: if a recurring payment fails, your monthly plan may be suspended or terminated. We reserve the right to pursue any outstanding balances.

• Cancellation policy: you may cancel your recurring monthly plan at any time by logging into your account on realsubmissiongrappling.com and adjusting your subscription settings under 'My Subscriptions', or by emailing us at info@realsubmissiongrappling.com with a cancellation request at least 5 business days prior to your next billing cycle. Cancellations typically take effect at the end of the current billing cycle. No refunds will be issued for partial billing periods or for past charges.

6.4. Refunds

All sales of single private/group classes, training packages, and monthly plans are final. No refunds will be issued for unused classes, partial packages, or any portion of a membership term, unless otherwise specified in writing or required by Florida law.

 

7. Waiver and Release of Liability (Crucial Disclaimer)

Participation in physical training is voluntary and at your own risk. By registering for classes or participating in any Jiu-Jitsu activities or training offered by Real Submission Grappling, you acknowledge and agree that martial arts training carries inherent risks of injury, including but not limited to sprains, fractures, dislocations, concussions, and even death. You voluntarily assume all risks associated with participation in our programs and training activities. You understand that physical participation in our classes requires the signing of our separate, comprehensive "Participant Waiver and Release of Liability, Assumption of Risk, and Indemnification Agreement". This waiver includes specific statutory language for minor participants as required by Florida law. Your participation in any physical training is conditional upon your execution of this separate waiver.

 

8. Health, Medical and General Information Disclaimer

All content on this Site is provided for general informational purposes only. It is not a substitute for professional advice or medical consultation. Always consult with a qualified healthcare professional before beginning any new exercise program, especially if you have any pre-existing medical conditions or concerns. Our instructors are not medical professionals and cannot provide medical advice.

 

9. No Guarantees of Results

While we strive to provide high-quality instruction and a beneficial training environment, we do not guarantee any specific results or outcomes from your participation in our Brazilian Jiu-Jitsu training, programs, or use of our Site. Results are highly individual and depend on various factors including, but not limited to, your personal effort, consistency, physical condition, and adherence to instruction. We are not responsible for any personal results, improvements, or lack thereof. Please note that achieving desired results requires consistent training, actively working on improving your skills, and being open to the instructor's guidance. Our training is designed to help each participant improve their skills and benefit from the training process, even if specific physical achievements are not guaranteed.

 

10. Intellectual Property

All content on the Site, including text, graphics, images, audio clips, video clips, data compilations, and software, is the property of Rickros Submission Grappling LLC or its content suppliers and is protected by United States and international copyright laws.

The name "Real Submission Grappling," the stylized "RSG" abbreviation, the distinctive shield logo, and any slogans or taglines used in connection with our services, are trademarks, service marks, or trade dress owned by Rickros Submission Grappling LLC. These marks are protected by common law, and you are prohibited from using them without our prior written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our prior written consent. Nothing in these Terms grants any right, title, or interest in or to the Site or any content on the Site.

 

11. User Conduct

All members and visitors are expected to uphold a respectful and positive environment within our community and during all interactions with RSG. We reserve the right to deny access or terminate services for behavior that is disruptive, unsafe, or discriminatory. You agree not to use the Site or its membership or subscription features in any way that:

• violates any applicable federal, state, local, or international law or regulation

• infringes upon or violates our intellectual property rights or the intellectual property rights of others

• is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable

• transmits any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation

• contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment

• disrupts the normal flow of dialogue within the membership community or interferes with other members' ability to use the services.

 

12. Use of Student Photos/Videos 

We capture photographs and videos of students (adults and children) during training sessions, events, and other activities for promotional, marketing, or educational purposes, including but not limited to our website, social media, and digital platforms.

• For Adult Participants: by participating in any Real Submission Grappling activities or events (including, but not limited to, classes, private lessons, free trials, workshops, or tournaments), you agree to our separate "Photo/Video Release Form" which details the terms of such use.

• For Minor Participants: for participants under 18, we require documented parental or legal guardian consent via our "Photo/Video Release Form for Minors." This form explicitly addresses the use of a minor's likeness and is obtained prior to participation in any Real Submission Grappling activities or events.

13. Disclaimer of Warranties; Limitation of Liability

The Site and all content, services, and products provided through it are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. Rickros Submission Grappling LLC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. In no case shall Rickros Submission Grappling LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions don't allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless Rickros Submission Grappling LLC, its affiliates, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site, including, but not limited to, any use of the Site's content, services, and products other than as expressly authorized in these Terms.

 

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States without regard to its conflict of law principles, except as otherwise required by applicable consumer protection laws in your jurisdiction. Any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be exclusively brought in the state or federal courts located in Miami-Dade County, Florida, United States.

 

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
